Conditions of business definitions: “the company” 247kit.tv, its successors and assigns.“the customer” the individual, company, or organisation hiring or purchasing equipment or services from the Company.“Equipment” all items supplied on hire, including accessories, cases, cables, and any replacement or substituted items. “Services“ all work or technical support provided by the Company.
1. Hire Period & Charges
Hire charges commence when equipment leaves the Company’s premises or is delivered to the Customer and continue until all equipment is returned, checked, and accepted by the Company in good condition. Daily, weekly, and extended rates apply as published. Hire continues at daily rate until return is confirmed.
2. Payment Terms
Payment is due upon invoice unless otherwise agreed in writing. Prices exclude VAT.
Late payments accrue interest at 8% above HSBC base rate and may incur a 20% recovery fee plus admin costs.
Quotes are valid for 14 days unless otherwise stated. The Company reserves the right to vary rates without notice.
3. Deposit & Security
A security deposit may be required prior to release of equipment. Deposits are refundable upon satisfactory return, less any deductions for loss, damage, or overdue hire charges.
4. Delivery & Collection
Delivery and collection are chargeable unless otherwise stated.
Risk transfers to the Customer upon delivery or collection. The Customer must inspect and sign for equipment at handover; any defect must be reported immediately.
Failed delivery or collection due to Customer inaction may incur additional charges.
5. Customer Responsibilities
The Customer must:

Use equipment in a skilful and safe manner by competent, trained personnel.

Comply with all health and safety laws, including PUWER and the Electricity at Work Regulations.

Not sub-hire, lend, or move the equipment to another address or outside the UK without written consent.

Keep equipment secure and protect it from theft, damage, or adverse conditions.

Notify the Company immediately of any fault, loss, or damage.
No repair, modification, or interference may be made without written approval.
6. Insurance
The Customer must insure the equipment at full new-for-old replacement value including loss of hire charges and liability for injury or damage arising from use.
Evidence of insurance must be provided prior to collection or delivery.
7. Damage, Loss & Non-Return
The Customer is liable for all loss or damage (other than fair wear and tear).
Replacement value is the current new replacement cost plus VAT and shipping.
Hire charges continue until payment for replacement or repair is received.
The Company may charge for missing accessories individually.
8. Cancellations
Confirmed bookings cancelled within 7 days of hire commencement are charged 50%.
Cancellations within 48 hours are charged 100%.
Provisional bookings not confirmed may be released without liability.
9. Termination
The Company may terminate hire immediately if the Customer defaults on payment, becomes insolvent, or breaches these terms. Upon termination, all equipment must be returned immediately, and the Company may enter premises to recover its property.
10. Limitation of Liability
Nothing in these Terms limits the Company’s liability for death or personal injury caused by negligence.
To the fullest extent permitted by law, the Company shall not be liable for indirect or consequential loss, including production delays or loss of profits.
Direct liability shall be capped at the total hire or purchase price paid.
11. Force Majeure
The Company shall not be liable for failure or delay caused by events beyond its control, including but not limited to fire, flood, pandemic, industrial action, or equipment unavailability.
12. Customer Property
Any property brought onto the Company’s premises is at the Customer’s sole risk. The Company accepts no liability for loss or damage howsoever caused.
13. Title to Goods Sold
Title to goods sold remains with the Company until full payment is received. Risk passes on dispatch.
If goods are resold before payment, proceeds are held on trust for the Company.
14. Indemnity
The Customer shall indemnify the Company, its directors and staff against all claims, costs, and liabilities arising from the hire or use of the equipment, including third-party claims and breach of these Terms.
15. Miscellaneous

These Terms and any related hire form or quotation constitute the entire agreement.

If any clause is held invalid, the remainder shall continue in full effect.

Notices may be sent by email or post to the last known address.

The Company may sub-contract services.

These Terms are governed by English law, and disputes shall be subject to the exclusive jurisdiction of the Courts of England and Wales.
